These terms govern the use of Kinstone's website and services. By making an enquiry, booking a session, or using this website, you agree to these terms. If you have questions, contact [email protected].
1. Definitions
- "Kinstone", "we", "us", "our" — Kinstone, operating from 45 Jalan Tebrau, 80300 Johor Bahru, Johor, Malaysia.
- "Services" — the document organisation education and household records literacy sessions described on this website.
- "User", "you" — any individual or organisation accessing this website or booking a session.
- "Session" — any Records Chart and Document Index Session, Household Transition Logistics Course attendance, or Community Family Services Capability Programme engagement.
- "Agreement" — these Terms & Conditions, together with any session booking confirmation.
2. Acceptance of terms
By submitting an enquiry form, booking a session, or using this website, you confirm that you are 18 years of age or older and have the capacity to enter into this agreement. Use of the website constitutes acceptance of these terms.
3. Service description
Kinstone provides general education and document organisation support. Specifically:
- Sessions cover administrative structure, document indexing, safe storage, and records literacy.
- Sessions do not constitute legal advice, financial advice, counselling, or any form of regulated professional service.
- Any question that falls outside administrative support will be redirected to an appropriately qualified professional.
- We work with the structure and location of documents, not their legal or financial meaning.
Services are available to individuals and organisations in Malaysia. Online delivery is available for participants outside Johor Bahru.
4. Booking and payment
- Session bookings are confirmed upon receipt of the agreed fee.
- Fees are stated in Malaysian Ringgit (RM) and are confirmed before any commitment is made.
- Current fees: Records Chart Session — RM 470; Logistics Course — RM 1,620 per participant; Capability Programme — RM 4,690 per organisation.
- Payment methods and instructions are provided at the point of booking.
- Fees are non-refundable after the session has commenced unless Kinstone cancels the session.
5. Cancellation and rescheduling
- Cancellations made more than 5 working days before the session date are eligible for a full refund or reschedule.
- Cancellations within 5 working days are not eligible for a refund but may be rescheduled once at no additional cost, subject to availability.
- If Kinstone cancels a session, a full refund or reschedule will be offered.
- For the Logistics Course, withdrawal after the first session is not eligible for a partial refund.
6. User responsibilities
- You agree to provide accurate contact information when making an enquiry or booking.
- You agree not to record sessions without the prior written consent of Kinstone.
- You agree not to misrepresent the nature or scope of Kinstone's services to third parties.
- For the Community Programme, the organisation agrees to involve its own qualified professionals in the development of any governance framework.
7. Intellectual property
All written materials produced by Kinstone — including workbooks, chart templates, checklists, and curriculum materials — remain the intellectual property of Kinstone unless otherwise agreed in writing.
- Individual participants may use session materials for their own household purposes.
- Organisations that commission the Community Programme receive a licence to use bilingual information materials within their organisation. This licence does not transfer ownership.
- Materials may not be reproduced for commercial purposes without written permission from Kinstone.
8. Disclaimers
- Kinstone's services are provided as general education and document organisation support. They are not a substitute for legal, financial, or professional advice.
- Kinstone does not make any representation as to the outcome of using the records or index produced in sessions.
- Session content is provided in good faith based on current administrative knowledge. We do not accept responsibility for changes to administrative requirements that occur after a session is delivered.
9. Limitation of liability
To the fullest extent permitted by Malaysian law, Kinstone's liability for any claim arising from our services is limited to the fee paid for the specific session to which the claim relates. Kinstone is not liable for indirect, consequential, or incidental losses.
10. Indemnification
You agree to indemnify and hold harmless Kinstone and its staff from any claims, losses, or expenses (including legal costs) arising from your misuse of our services or breach of these terms.
11. Termination
Kinstone reserves the right to decline or discontinue services at its discretion, in which case any prepaid fees for sessions not yet delivered will be refunded. Sections 7, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or our services shall first be addressed through informal resolution. If informal resolution is unsuccessful within 30 days, the dispute may be referred to the courts of Malaysia, with jurisdiction in Johor Bahru.
13. Severability and waiver
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full effect. Failure to enforce any provision at any time does not constitute a waiver of that provision.
14. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of the page reflects when they were last revised. Continued use of the website or services after a change constitutes acceptance of the updated terms.
